1. Acceptance of Terms
By accessing or using Neverland (accessible via neverland.thegenius.cc), an independent digital product by thegenius.cc, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.
2. Nature of Service
Neverland is an automated celebration dispatch platform that allows authenticated senders to schedule personalized messages, digital keepsakes, and occasion reminders for intended recipients delivered via electronic communication channels.
3. User Accounts and Authentication
To schedule celebration dispatches, you must authenticate using supported identity providers (such as Google). You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
4. Acceptable Use Policy
You agree not to use Neverland to send unsolicited commercial messages (spam), harassment, defamatory content, hate speech, malware, or any material that violates applicable local or international laws. We reserve the right to terminate accounts that violate this policy.
5. Email and Communications Delivery
Neverland delivers scheduled messages on the date selected by the sender. While we engineer our delivery systems with high reliability, delivery times may depend on recipient mail servers, internet service provider constraints, and third-party delivery infrastructure.
6. Privacy and Data Protection
Your privacy is paramount. We do not sell your personal information or your recipients' contact details to third parties. Please refer to our Privacy Policy for details on data retention and encryption.
7. Limitation of Liability
Neverland and thegenius.cc are provided "as is" without warranties of any kind. Under no circumstances shall the operators of the service be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the service.
